Compulsory Attendance Ages:
7 to 15, then secondary for 4 years.
Legal Status:
Homeschooling is legal in Serbia, but is intended for children with disabilities or illnesses which prevent them from full-time school attendance and which require special education accommodations. When parents whose children do not meet these criteria have tried to receive permission, they are told there must first be an amendment to the law, so parents are forced to send their children to public school. There are only a few private schools in Serbia. If a parent is allowed to homeschool, they would have no control over what the child would learn.
According to the Law on Primary Education, Article 8 states: “[A] parent or guardian has the right to choose for their child the primary education in a public or private school, i.e. home schooling or distance learning.”
Home education is addressed further in Article 38:
- Parents (i.e. guardians) have the right to organize for their child primary school education at home.
- Parents (i.e. guardians) must, by the end of the academic year, notify in writing the school attended by the child, i.e. the school where the student is enrolled, about the intention to organize home schooling for their children from the next school year.
- The school from paragraph 2 of this Article must organize the taking of class exams in all subjects in accordance with the curriculum.
- Primary school education at home must ensure achievement of the prescribed goals, outcomes and achievement standards.
- For students with special needs and disability who are being home schooled through implementation of an individual educational plan with adapted standards, the home schooling shall ensure achievement of adapted standards.
- Education may also be implemented as distance learning upon request of parents (i.e. guardians).
- The school shall make a decision about the distance learning on the basis of available resources necessary for this type of education.
- The school shall maintain records of education of students who are home schooled and taking distance learning.
- More detailed conditions for implementation and manner of securing quality and valuation of home schooling and distance learning will be prescribed by the Minister.
