Dear HSLDA Members and Friends,

Late last week, the Lee County Public Schools Home Education Department sent a mass mailing to the home education families throughout the county. We have been contacted by several families in Lee County about this mailing, which included a letter and form regarding “Florida End-of-Course Assessments.” We were also notified that homeschooling families had received multiple copies of this mailing in their mailbox, some receiving as many as 9 or 10 copies.

The language of the mailing is misleading, as it strongly indicates that homeschooling families are obligated to participate in the Florida End-of-Course Assessment, and directing that the included “Information Sheet for Testing” must be returned to the Home Education office no later than September 19, 2014.

According to Florida Statutes 1002.41(c) a parent is required to provide “an annual educational evaluation in which is documented the student’s demonstration of educational progress at a level commensurate with her or his ability.” The annual evaluation may be completed by using one of five options, as outlined in Section 1002.41(c). Taking “a state student assessment test used by the school district,” such as the Florida End-of-Courses (EOC) Assessment, is just one of the five available methods of conducting the annual evaluation.

There is no requirement that homeschooling families choose to participate in the school district’s assessment and thus no need for any homeschooling family in Lee County to respond to the recent mailing from Lee County Public Schools if you are not planning on utilizing the Florida EOC Assessment for your student’s annual evaluation.

We have contacted Lee County Public Schools regarding their mailing and have informed them that it is in error. We informed them that homeschooling families are not obligated to participate in the Florida EOC Assessment or respond to their mailing. We will be working with local school officials to bring a resolution to the situation, so that there is clarity regarding the law.

In the meantime, please let us know if you are contacted by anyone from Lee County Public Schools.
