Summary:

House Joint Resolution 45 proposes a state constitutional amendment to protect private schools from regulation from the state and local governments. If passed, the amendment will be submitted to Texas voters on the November 5 ballot for approval.

HSLDA's Position:

Support.

Since homeschools in Texas are recognized as private schools, HJR 45 will effectively protect homeschool rights in the Texas Constitution. Texas homeschool rights are currently recognized in case and statutory law, not the Texas Constitution. To preserve homeschool rights for future generations, HJR 45 will place these rights in the state constitution and guard against unwanted regulation.
