Commonwealth v. Mrs. R
Certified teacher subject to prosecution for home schooling

Filed: No charges have been filed at this point; Westmoreland County.

Nature of Case: Mrs. R, a certified teacher and a member of the local school board, began home schooling this fall under Pennsylvania's private tutor option. However, the Pennsylvania Department of Education has recently reversed itself; an attorney at the Department of Education has opined that it is not legal for parents to home educate under Pennsylvania's private tutor statute.

Status: The solicitor says the state will not prosecute until the Pennsylvania Department of Education gives further guidance. HSLDA has met with the Secretary of Education, Charles Zogby, but the issue remains unresolved.
