Family Stands on 4th Amendment

When the Gregory family (name changed to protect family’s privacy) received an unexpected visit from a caseworker, they turned to Home School Legal Defense Association for help.*

Pursuant to HSLDA’s advice, the Gregorys courteously turned down the caseworker’s request to inspect their home and interview their children. They discovered that the allegations against them concerned possible educational and medical neglect. Incredulous, the Gregorys called HSLDA and spoke with HSLDA Senior Counsel Christopher Klicka.

Klicka wrote a letter assuring the caseworker that the Gregorys were not neglecting their children, but were in fact providing them with better than average care, a homeschool education, and appropriate medical services. Klicka also had Mrs. Gregory send the caseworker a letter from the family doctor indicating that the children were receiving proper medical attention. In addition, Mrs. Gregory gave the caseworker the names and phone numbers of several individuals who could vouch for the Gregorys’ loving parenting.

In his letter, Klicka made it clear that the family wished to avoid unnecessary trauma and would decline any requests by the caseworker to enter their home or interview their children. Klicka indicated that should the caseworker need any further information from the family, Mrs. Gregory would be glad to provide it.

Apparently, the letter was sufficient evidence to close the case, because the Gregorys have not heard from the caseworker since.
